The Service lets you provision servers from third-party infrastructure providers and deploy applications, databases, and related resources onto them. We are a platform that automates provisioning and management — we do not own or operate the underlying physical infrastructure.
You're responsible for maintaining the security of your account and for all activity under it. Provide accurate information when registering and keep it up to date.
New accounts receive a time-limited free trial covering a single server. If no payment method is added before the trial ends, that server is suspended, and permanently deleted (see Section 6) if a payment method still hasn't been added after the suspension period shown in-product.
Paid servers are billed on a recurring basis through our payment processor. If a payment fails:
You'll be notified at each of these steps. You can restore service at any point before deletion by updating your payment method.
In addition to payment failure (Section 5), we may suspend or terminate a server or account for violation of these Terms, suspected fraud or abuse, or a legal or security requirement. Suspended servers not restored within the retention period shown in-product are permanently deleted.
The Service depends on third-party infrastructure providers (e.g., the servers we provision on your behalf) that we do not control. We are not responsible or liable for outages, downtime, data loss, or degraded performance caused by a failure, outage, or issue at an underlying infrastructure provider. We do not guarantee any specific level of uptime or availability. The Service is provided "as is" and "as available," without warranties of any kind, express or implied.
You are solely responsible for backing up your own applications, databases, and data. We are not liable for any data loss, including data lost due to a suspension, deletion, or provider outage described above.
You agree not to use the Service for anything illegal, to host malware, to attack or abuse other systems (including our infrastructure or that of the underlying providers), or to violate any third party's rights. We may suspend or terminate access immediately for a violation of this section.
To the maximum extent permitted by law, [Company name] and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or profits, arising from your use of the Service, even if advised of the possibility of such damages. Our total liability for any claim arising from these Terms or the Service is limited to the amount you paid us in the [3 months] preceding the claim.
We may revise these Terms at any time. When we do, the version above changes, and you'll be asked to review and accept the new version the next time you use the Service. Continuing to use the Service after accepting a new version means you agree to it.
You may stop using the Service and delete your servers and account at any time from your dashboard. Sections that by their nature should survive termination (e.g., limitation of liability) continue to apply.
